The Supreme Court has struck down much of Arizona's immigration law, SB 1070:
Arizona may have understandable frustrations with the problems caused by illegal immigration while that process continues, but the State may not pursue policies that undermine federal law.The provisions of SB 1070 the court invalidated:
- Section 3: State misdemeanor for being in the country illegally.
- Section 5(C): State misdemeanor for knowingly applying for unauthorized work.
- Section 6: Arrest of illegal immigrants based on probable cause.
SCOTUS punted on one provisions, stating it was too early to rule on section 2(B) until state courts had an opportunity to render an opinion.
