2nd Amendment Upheld by a Single Vote

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

A single vote, that's all that stood between liberty and tyrany today when the Supreme Court of the United States of America ruled on District of Columbia v. Heller.

In his affirmation, Justice Scalia wrote:

[T]he Second Amendment right is exercised individually and belongs to all Americans.

[T]he Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.

[W]e find that [the Second Amendment] guarantee[s] the individual right to possess and carry weapons in case of confrontation.

But again, one vote is all that stood between liberty and those who would take it away.

In dissent, Justice Breyer, joined by Justice Stevens, Justice Souter, and Justice Ginsburg, stated that the purpose of the Second Ammendment was only in-part for individuals to provide their own defense. In cases where the government can provide better defense it would be acceptable, for the peoples' own good, to limit the right of the people to keep and bear arms. Basically, they believe the people in DC will kill each other if they have hand guns, so it is the duty of the government to protect them from themselves.

Interesting point, but if it were a valid one, who excatly is supposed to protect the people from their government?

Number 1, if the people haven't risen up YET to overthrow a tyrancical, over-reaching federal government that is methodically stripping them of their rights and elevating the power of the president far above the power of the peoples elected representatives in Congress, then when in the hell will they get the cajones to do so, eh?

Number 2, if you (or they) do in fact wake up and decide to water the tree of freedom with the blood of patriots, let me know how well that locker full of hunting rifles and ammo cache do against smart bombs, night vision goggles, Navy Seals and Abrams M1 main battle tanks.

In case you hadn't noticed, the days when the gummint had a musket and you got a musket so we're even steven ended a very, long time ago.

Funny. You would think the Iraq War would have shown you how easy it is for a small group of determined people to hold off the United States Military. Add to that, how hard to you think American soldiers will work to kill fellow Americans?

Wow, that last sentence was gibberish.

On top of the tactics used by opposition forces in Iraq, it is going to be a very difficult task for fellow Americans to drop bombs on their friends and families.

That ban in D.C. didn't do much in the way of curbing murders. The number of murders jumped from 188 in 1976 when the ban was implemented to 482 in 1991.

By all means! Lets have open gun battles in the streets of our nation's capitol! Citizen against citizen, mano a mano, that will set a FINE example for the rest of the world. I'm sure every nation in the world will want to be just like us!

We're killing people we don't like half a word away and we're killing our neighbors here at home.

What a bright, shining city on hill we have become. A beacon of freedom.

No... you're right! All throughout the eighties when handguns were supposed to be illegal, that's when murderers in DC were stomping around saying:

"Kill! Kill! Kill!"

And kill they did.

You already had your liberal chance. They did run around the city for 30 years killing, killing, killing!

12 million illegals in our country did everything they could to get in here. We must be doing something right.

Handgun bans didn't work. So now you libs are trying to scare us with whimsical fantasies of old-west shoot outs (which already occurred under the handgun bans). And when you realize that the folks with common sense still aren't listening, what are you going to do?

The same thing all the other great socialists of our time did: resort to violence. Violence is in the liberal blood. Think about it. Most criminals I've talked to over the years have almost always been Democrats. Those criminals who completely reformed themselves were always Republican.

Someone ought to take a poll in our prisons this year and see who they all want to win this presidential election.

You should read Scalia's opinion. He went through point by point in explaining the 2nd amendment. I really like this little piece which is found on page 16 of his opinion:

"Giving “bear Arms” its idiomatic meaning would cause the protected right to consist of the right to be a soldier or to wage war—an absurdity that no commentator has ever endorsed. See L. Levy, Origins of the Bill of Rights 135 (1999). Worse still, the phrase
“keep and bear Arms” would be incoherent. The word “Arms” would have two different meanings at once: “weapons” (as the object of “keep”) and (as the object of
“bear”) one-half of an idiom. It would be rather like saying
“He filled and kicked the bucket” to mean “He filled the bucket and died.” Grotesque."
